These General Terms of Sales and Use are concluded between ; HIBINOKURASHI who is hosted and operate this Internet site HIBINO KURASHI.com, and all person visiting physically or buying products offered on this site.

HIBINOKURASHI reserves the right to modify and update these Terms of Sales and Use conditions at any time.Nevertheless,the General Terms of Sales and Use conditions applicable to the order placed by Customer on this site are those accepted by the Customer at the time of placing the order.

Working day and time

The Customer can place an order by Internet 24/24 hours and 7/7 days.
Customer service HIBINOKURASHI working days by telephone are from Wednesday to Saturday from 13 - 17 oclock.

Ordering process

The Customer wishing to purchase a product featured on the site HIBINOKURASHI must follow the ordering process HIBINOKURASHI defines.

Once product selection has been carried out by clicking on the icon “add to shopping cart”,a summary page will be displayed automatically featuring a photograph of the item, its references, the quantity selected, its unit price.The Customer should check that this information accurately reflects his selection,then estimate shipping cost by selecting the country and click on the icon “calculate the total amount of order”.

Once the Customer has selected the country and the total amount of order shown,the Customer must select the payment method between Stripe Check-out and other payments by cash like bank transfer and cash on delivery. Please be aware that for International shipment,HIBINOKURASHI accept Stripe only.

For payment by Stripe,the Customer will be automatically redirected to Stripe site and proceed the payment on their site.The Customer can select the language between english and Japanese at the upper right side of of Stripe site and must enter the informations requested for payment and shipment in the Stripe form.

For other payments,HIBINOKURASHI request to the Customer to enter the contact informations including: surname,first name,email address,phone number and e-mail address,on this site.The Customer may choose to deliver his order to an address different from that entered address before.In this case,the Customer must fill out his delivery address in the appropriate form.

When the form entered,the Customer must choose the payment between bank transfer or cash on delivery.Then,the Customer has access to a final summary of order and shipment including an additional handling fee for cash on delivery.The Customer must check this final summary of order and validate definitely an order by clicking on the icone “checkout”

When finished,an E-mail is automatically sent to the Customer in order to confirm the order.Also an another new E-mail with tracking number to confirm the shipment.

HIBINOKURASHI reserves the right to refuse or cancel any order and shipment,when autorisation of payment via Stripe is refused by officially accredited organizations or any order and shipment with whom it has a dispute concerning a prior order or in the case of non-payment.

Informations on the products

1- Informations and photographs:

Informations and photographs of products presented on this site HIBINOKURASHI.com are only on a property indicative basis. HIBINOKURASHI will make its efforts to ensure that the photographs of product are as faithful as possible. But nevertheless possible that the photographs and colors of products displayed on this site does not correspond to the original products colors due to the technical restrictions of color reproduction on the computer equipment.
HIBINOKURASHI can not guarantee the inaccuracy in the photographs of products displayed on this site.

2- Price:

The product prices can be quated in Euros,US dollars,Pounds Sterling or Yens in accordance with your chosen currency and the taxes are included.The price does not include the shipping cost and gift wrapping fee which will be indicated before the final confirmation of the order.

The Japanese VAT (Consumption tax in Japan) 10% is applicable in Japanese only.For international shipment,10% of the Japanese VAT is automatically removed from total amount of the order and indicated on the summary of order before the final confirmation of the order.

HIBINOKURASHI reserves the rights to amend at anytime and without any previous notice the prices of the products on this site.However,the prices are applicables on the moment of ordering and order confirmation.The prices cannot be modified once the Customer has placed his order.

Order confirmation

At the end of the ordering procedure, you are invited to click on the “Check Out”.From that final click of acceptance,the order is considered as irrevocable.The order will be not modified or cancelled anymore.

The order confirmation implies that the Customer has accepted these General Terms of Sale and Use and the Privacy Policy of this website in full.

After that order confirmation,an email is automatically sent to the Customer in order to confirm the order provided that email address indicated in the inscription form.

Payment

The Customer can pay his order online by Stripe and bank transfer, cash on delivery for shipment in Japan.
All orders are payable in Euros,US dollars,Pounds sterling or Yen by Stripe,according to currency that the Customer has selected at the moment of order.

1- Credit Card via Stripe:

Quick and security online payment service.People all around the world,more than 25 countries are using Stripe.

From that final click of acceptance,the order is considered as irrevocable.The order will be not modified or cancelled anymore.
The order confirmation implies that the Customer has accepted these General Terms of Sale and Use and the Privacy Policy of this website in full.

After that order confirmation,an email is automatically sent to the Customer in order to confirm the order provided that email address indicated in the inscription form.

2- Bank transfer:

The payment by bank transfer is accepted for shipment to Japan and payment in Yens only.
The Customer must pay the totality of invoice amount including shipping fees to HIBINOKURASHI bank account, within 7 working days from order confirmation date.

The bank transfer fees are chargeable to the Customer.

The products ordered remain the property of HIBINOKURASHI until full payment of the order by the Customer.In the event of non-payment by the Customer before the due date,whatever the cause,HIBINOKURASHI reserves the right to cancel an order immediately.

3- Cash on delivery by YAMATO Transport

Cash on delivery services by YAMATO Transport are available on deliveries to Japan and payment by cash in Japanese Yens only.
The Customer should pay the totality of invoice amount, including shipping fees and cash on delivery 330yen fees to the postal courier in cash at the time of delivery.

The products ordered remain the property of HIBINOKURASHI until full payment of the order by the Customer.In the event of non-payment by the Customer before the due date,whatever the cause,HIBINOKURASHI reserves the right to cancel an order immediately.

Delivery and shipping fees

The products are delivered to the address indicated by the Customer on the purchase order. The Customer must check the conformity of the information which he provides to HIBINOKURASHI. The latter cannot be held responsible for possible errors of data entry and the consequences in terms of delay or delivery error. In this context, all expenses engaged for the re-forwarding of an order will be entirely the responsibility of the Customer.

The products will be delivered within 3 working days of the completion of payment from our customer service.We will notice on top page of this site in case of delay.

2- Shipping method and charges for delivery to Japan:

Delivery by KURONEKOYAMATO.The usual delivery time of 24 h – 48 h from dispatch to the Post.
The Percel is dealt with by YAMATO Transport and is delivered upon being signed for at the delivery address indicated by the Customer.In the event of absence at the moment of delivery,the postal courier will deposit a delivery notice.The Customer should contact the client service of YAMATO Transport by telephone or internet to fix the new delivery date and time zones.

Transport fees are calculated according to the size of parcel and delivery zones with 600yens as additional fees for packing of international shipping.Please check out this shipping table defined by YAMATO Transport.

3- Shipping method and charges outside Japan:

Delivery by YAMATO Transport (usually UPS in your country) or Japanese Post by EMS service . The usual delivery time of 3 days – 14 days from dispatch to the office or Post.

List of Delivery Days

The parcel is dealt with by YAMATO Trapsport or Japanese Post and is delivered upon being signed for at the delivery address indicated by the Customer. The Customer must take care to give all necessary information for access to the place of delivery (code, building, floor, etc.), as well as a telephone number where the Customer is easily reachable.

Transport fees are calculated according to the weight of parcel and destination.Please check out this shipping table.

For shipment outside Japan,the Client should agree to pay all taxes due on importation,whether tarifs, tax on the value of the goods or any charges due under the laws of the country receiving the order.
HIBINOKURASHI does not take responsible for non-payment of such taxes from the Customer.

4- Order tracking:

An email is automatically sent to the Customer from Customer service HIBINOKURASHI in order to confirm the dispatch of parcel with delivery date and tracking number.The Customer can follow his order at any moment with that tracking number on YAMATO Transport or JAPAN POST website by Internet.

5- Delays in delivery related to the transporter:

In the case of a delay in delivery compared to the delivery times announced by the transporters,at first,the Customer should check and follow the parcel with tracking number by Internet,to see whether the parcel is not about to be dispatched.
If the need arises,the Customer must contact HIBINOKURASHI Customer services by email or telephone in order to make a file of contention or start an investigation to carry out a search of the parcel.
In case of mislaid and lost of parcel,HIBINOKURASHI assumes responsibilities of contacting the transporter.

If the parcel is found,it will be sent immediately to the Customer.In the event of not found, HIBINOKURASHI will be able to send the same product again at HIBINOKURASHI's expense,or be refunded the amount paid.If the products are not available at the moment,HIBINOKURASHI will refund the amount paid to the Customer.

6- Checking percel on receipt:

It is responsibility of the Customer to inspect his parcel upon reception in the presence of the post courier and notify the transporter as well as HIBINOKURASHI of any anomaly as bumps,damage to the parcel,delivery date no confirmed to regular delivery times) within three days after receipt of the parcel concerned.In the absence of noting such points,the products are considered to be accepted by the Customer and can not be the subject of any dispute concerning its delivery.The Customer must notify HIBINOKURASHI by email so that HIBINOKURASHI can take the necessary measures as quickly as possible.

Gift wrapping service

We have a gift wrapping service.The fees are 330yen with tax included.

Returns and Exchanges

No product will be refunded or exchanged except if error in sending products (nonconformity of product from order)by HIBINOKURASHI and damaged products.

In case of nonconformity of product from order,HIBINOKURASHI ask the Client to contact HIBINOKURASHI by email or telephone within 7 days from delivery for replacement or refund.The Client cannot return the products without contacting HIBINOKURASHI by email or telephone before.

The products are packaged so as to respect the standards of transport in force, and to ensure an optimal protection of the products during their delivery. HIBINOKURASHI request to the Customer to respect these same standards in the case of a product being returned. Any damage noted to a product arising from the product not being repackaged properly may lead to an only partial refund, or no refund in the event of the impossibility of resale in its state.
The Client must return the products unused. HIBINOKURASHI will take charge of return costs. HIBINOKURASHI will send a replacement product as soon as possible in event of replacement.

For refund,HIBINOKURASHI will refund the amount paid to the Customer within 10days from the day the concerned parties has reached agreement.

The applicable law

These General Terms of Sales and Use are subject to Japanese law.
